COLLATERAL ADMINISTRATION
The Refinancing Register is a capital markets tool developed by the German Banking Authority to provide an efficient method of transferring mortgage-backed securities for securitisation purposes.
Until now, the transfer of loan receivables to the buyer required the notarial transfer of collaterals and an entry change in the Land Registry. On the basis of this regulation, that came into force in 2005, land charges can be entered directly in the refinancing register, avoiding notarial costs and registry changes. This considerably reduces time and expenses in collateral management.
Using the Refinancing Register guarantees you an insolvency-proof position without asset transfer.
